Brian presented "Blockbuster Asbestos Claims Cases" at the Association of Insolvency and Restructuring Advisors (AIRA), 2006 West Coast Plan of Reorganization Conference. The program dealt with how to handle bankruptcy cases in which asbestos claimants are a major participant. The use of Section 524g of the Bankruptcy Code, which allows a debtor/defendant to "channel" the asbestos claims to a trust established under the plan of reorganization was explored. Brian Davidoff was a panelist in a program to the Beverly Hills Bar Association on the subject of "deepening insolvency." This is a newly emerging area of interest to lawyers in California and addresses whether lenders, officers and directors, professionals or enterprises that are in financial distress can be held liable if the business transaction in which they are involved results in the "deepening insolvency" of that business, i.e. the deal does not go right. 10/07/03: Kumagai Speaks on Pre-Petition Litigation Regarding Non-Dischargeable Debt
Duane Kumagai will be speaking on "Pre-Petition Litigation Regarding Non-Dischargeable Debt - The Impact of the Supreme Court's Decision in Archer v. Warner", presented by the Bankruptcy Committee of the Los Angeles County Bar Association. In the recent case of Archer v. Warner, the Supreme Court ruled that the doctrine of novation does not convert an otherwise non-dischargeable fraud claim into a dischargeable contract claim where the debtor enters into a pre-bankruptcy settlement agreement covering a fraud claim. This program will examine pre-bankruptcy litigation strategies as they may impact upon the prosecution of non-dischargeability cases in the event that the defendant later files a bankruptcy petition.
